General Terms and Conditions and Customer Information

I. General Terms and Conditions

§ 1 Basic Provisions

  1. These General Terms and Conditions apply to all agreements concluded by consumers or businesses with Reckmann GmbH via the online shop www.mobi-roll.de or by other means of distance communication. Any conflicting or differing customer terms shall not form part of the agreement unless their application has been expressly accepted in writing.
  2. A consumer within the meaning of these Terms and Conditions is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity.
  3. A business within the meaning of these Terms and Conditions is any natural person, legal entity or partnership with legal capacity acting in the course of its commercial or self-employed professional activity when concluding a legal transaction.

§ 2 Conclusion of the Agreement

  1. The agreements offered by Reckmann GmbH concern the sale and rental of medical mobility aids, accessories and associated services.
  2. The presentation of products and services in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.
  3. By submitting an order, the customer makes a binding offer to conclude an agreement. The agreement is concluded only when Reckmann GmbH expressly accepts the order, dispatches the ordered goods or hands over the medical mobility aid to the customer or to a person authorised by the customer to receive it.
  4. When ordering through the online shopping-basket system, the customer may review and correct all entries or cancel the ordering process at any time before submitting the binding order.
  5. Orders or requests for quotations submitted outside the online shop, particularly by e-mail, telephone or other means of distance communication, are initially non-binding. An agreement is concluded only when the offer is accepted by the other party.
  6. Order processing and all information relevant to the agreement are generally provided electronically by e-mail. The customer must ensure that the e-mail address provided is correct and that receipt of e-mails is not prevented, particularly by spam filters.

§ 3 Term and Amendments of Rental Agreements

  1. The term of the rental agreement is based on the rental period agreed in the applicable offer or order.
  2. Unless expressly agreed otherwise, the rental period begins when the medical mobility aid is handed over to the customer or to a person authorised by the customer to receive it. If it is shipped by a delivery service, handover is deemed to have occurred upon documented delivery.
  3. The rental period may generally be extended. An extension requires an agreement between the customer and Reckmann GmbH and may depend on the availability of the relevant medical mobility aid and, where applicable, a new medical prescription or authorisation from the payer.
  4. The agreed rental period may be shortened only by mutual agreement. The rental price will be recalculated according to the pricing structure applicable when the agreement is amended. If the amendment generates additional administrative work, Reckmann GmbH may charge a reasonable processing fee in accordance with the price list applicable at that time.
  5. Amendments to the rental agreement, particularly regarding the rental period, delivery address or other material contractual information, must be made in text form, for example by e-mail, unless the law requires a stricter form. Such amendments may result in adjusted delivery or processing times.

§ 4 Payment Methods and Payment Processing

  1. The available payment methods are displayed during the ordering process and on the relevant information pages of the online shop.
  2. If payments are processed by external payment service providers, their contractual terms and terms of use shall additionally apply. Reckmann GmbH has no influence over the contractual relationship between the customer and the relevant payment service provider.
  3. Payment transactions may be processed by appointed payment service providers. Only data required to process the payment and perform the agreement will be transmitted.
  4. The customer must ensure that the selected payment method is available and has sufficient funds when payment is processed.
  5. A payment is deemed to have been made only once the relevant amount has been finally and irrevocably credited to Reckmann GmbH.

§ 5 Right of Retention and Retention of Title

  1. The customer may exercise a right of retention only if the counterclaim arises from the same contractual relationship.
  2. In the case of purchase agreements, the delivered goods remain the property of Reckmann GmbH until the purchase price has been paid in full.

§ 6 Warranty

  1. Statutory rights relating to defects apply to purchase agreements.
  2. Customers are requested to inspect delivered goods and medical mobility aids immediately upon receipt for completeness, apparent defects and transport damage and to notify Reckmann GmbH and, where applicable, the carrier without delay. Failure to comply with this request does not affect the customer’s statutory rights.
  3. Any characteristics that differ from objective statutory requirements shall only be deemed agreed if the customer was expressly informed of the deviation before submitting their contractual declaration and separately consented to it.
  4. Under rental agreements, the customer must immediately notify Reckmann GmbH of any apparent defects, malfunctions or damage. If safe use is impaired or a safety-related defect exists, the mobility aid must not be used until the defect has been clarified or remedied. The customer’s statutory rights and claims under the rental agreement remain unaffected.

§ 7 Governing Law, Place of Performance and Jurisdiction

  1. The law of the Federal Republic of Germany applies. For consumers, this choice of law applies only insofar as it does not restrict mandatory consumer-protection provisions of the country in which the consumer habitually resides.
  2. If the customer is a merchant, a legal entity under public law or a special fund under public law, the registered office of Reckmann GmbH is the place of performance and exclusive place of jurisdiction for all disputes arising from the business relationship. The same applies if the customer has no general place of jurisdiction in Germany or the European Union, or if their habitual residence is unknown when proceedings are initiated.
  3. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

6. Prices and Payment Terms

6.1. The prices stated in the relevant offers are total prices. They include all price components, including statutory VAT where applicable.

6.2. Delivery, shipping and any return costs are not included unless expressly stated otherwise. The applicable costs are shown separately before the order is completed.

6.3. Deliveries to countries outside the European Union may incur additional costs, particularly customs duties, taxes or fees, which Reckmann GmbH cannot influence and which must be paid by the customer.

6.4. The customer bears any costs resulting from money transfers or currency conversions unless Reckmann GmbH is responsible for them.

6.5. The available payment methods are displayed during the ordering process.

6.6. Unless otherwise stated for the selected payment method or in the offer, all payments are due immediately after conclusion of the agreement.

7. Delivery Conditions

7.1. Delivery conditions, delivery times and any restrictions are set out in the relevant offer and in the information provided on the Reckmann GmbH website.

7.2. If the customer is a consumer, the risk of accidental loss of or damage to purchased goods during shipping passes only when the goods are handed over to the customer or to a person authorised by the customer to receive them. This does not apply if the customer independently commissions a carrier or other person not designated by Reckmann GmbH to perform the shipment.

8. Returns

8.1. In the event of a statutory withdrawal, only the provisions of the current cancellation policy apply.

8.2. Returns of goods or medical mobility aids outside the scope of a statutory withdrawal are governed by the applicable contractual agreements and the return instructions issued by Reckmann GmbH.

8.3. Unless otherwise agreed, medical mobility aids must be returned after the end of the rental period complete, clean and in a condition consistent with proper contractual use.

9. Statutory Liability for Defects

Statutory rights relating to defects apply to purchase agreements. Supplementary provisions are contained in Section 6 of the General Terms and Conditions, Part I.

10. Term and Termination of Rental Agreements

Information on the term, extension and termination of rental agreements is contained in Section 3 of the General Terms and Conditions, Part I, and in the relevant offer.

§ 11 Medical Provision and Contractual Relationship

  1. The sole contractual partner to the rental or purchase agreement is Reckmann GmbH. A statutory or private health insurance provider, long-term care insurance fund, employers’ liability insurance association, accident insurance provider or other payer does not become a contractual party as a result of a medical prescription, reimbursement application or reimbursement procedure.
  2. The customer’s obligation to pay the agreed rental or purchase price applies regardless of whether and to what extent a payer covers or subsequently reimburses the costs. The customer bears the sole risk of complete or partial refusal of reimbursement.
  3. If the mobility aid is supplied before the payer has made a decision, this is done at the customer’s request under the rental or purchase agreement concluded between the parties.
  4. Any subsequent approval, rejection, reduction or delay in reimbursement does not affect the validity of the agreement or the customer’s resulting payment obligations.
  5. If a payer makes payments directly to Reckmann GmbH or the appointed billing partner and those payments can be clearly allocated to the relevant agreement, they will be credited against the customer’s outstanding balance.
  6. Reckmann GmbH provides no guarantee regarding the approval, amount or timing of any cost coverage or reimbursement.

§ 12 Billing, Cost Coverage and Customer Cooperation

  1. Reckmann GmbH may use an external billing partner to conduct cost-coverage, authorisation or reimbursement procedures.
  2. The customer agrees that the personal data and contractual and service documents required to perform and bill the agreement may be transmitted to the appointed billing partner where legally permissible and necessary for contractual performance.
  3. Assistance with applications for cost coverage or reimbursement is voluntary and does not create any entitlement to approval by the relevant payer.
  4. The customer must provide all documents required for the relevant procedure completely, correctly and on time.
  5. If required documents are not submitted, or are submitted incompletely despite a request, Reckmann GmbH may discontinue its assistance with the cost-coverage or reimbursement procedure.
  6. Delays, refusals or other disadvantages resulting from the payer’s decisions or from incomplete, incorrect or late documentation are outside Reckmann GmbH’s responsibility.
  7. The initiation or conduct of a reimbursement or appeal procedure does not affect when contractual payments become due unless otherwise agreed in writing.

§ 13 Special Provisions for Rental Agreements

  1. The medical mobility aid is supplied exclusively for the agreed rental period and remains the property of Reckmann GmbH throughout that period.
  2. The tenant must handle the mobility aid with care, use it only for its intended purpose and comply with the operating and safety instructions. Permanent transfer or subletting to third parties and commercial or improper use are prohibited.
  3. Immediately after receipt, the tenant must check the aid for completeness, apparent damage and proper functioning and report any apparent defects without delay.
  4. Modifications, alterations or repairs may be carried out only by Reckmann GmbH or persons authorised by it.
  5. Defects, malfunctions or damage must be reported to Reckmann GmbH immediately upon discovery.
  6. At the end of the rental period, the mobility aid and all accessories must be returned complete and clean.
  7. Normal signs of use resulting from proper contractual use do not constitute damage. Otherwise, the statutory liability provisions apply.
  8. Loss or theft of the mobility aid must be reported to Reckmann GmbH immediately in writing.

§ 14 Return and Technical Inspection

  1. After the returned mobility aid is received, it undergoes a visual and functional technical inspection and hygienic reconditioning.
  2. Any damage or missing components will be documented. Any claims are governed by statutory provisions and contractual agreements.
  3. Reckmann GmbH may take photographs or video recordings before dispatch and after return to document the condition of the mobility aid.
  4. Any necessary maintenance, repair or hygiene measures may be performed before the device is rented again.
  5. If the mobility aid is not returned on time, Reckmann GmbH may continue charging the agreed rent until it is properly returned, to the extent permitted by law.

§ 15 Advice and Service

  1. Advice provided by Reckmann GmbH is based exclusively on information supplied by the customer and is not a substitute for medical, therapeutic or other healthcare advice.
  2. Delivery-time information is an estimate unless a binding delivery date has been expressly agreed.
  3. During the rental period, Reckmann GmbH provides reasonable assistance with questions regarding the operation and use of the mobility aid.
  4. In the event of a justified technical complaint, Reckmann GmbH will endeavour, within its operational capabilities, to arrange a prompt repair or replacement. There is no entitlement to immediate repair or replacement.
  5. There is no entitlement to a particular replacement device.

§ 16 Tenant’s Liability

In accordance with statutory provisions, the tenant is liable for all damage to the medical mobility aid and its accessories resulting from an intentional or negligent breach of duty.

§ 17 Force Majeure

Reckmann GmbH is not responsible for force majeure events, particularly natural disasters, strikes, official measures, pandemics or other unforeseeable events that materially hinder or prevent delivery or contractual performance. Delivery and performance deadlines are extended for the duration of the disruption.

§ 18 Final Provisions

  1. The medical mobility aids offered by Reckmann GmbH comply with the applicable statutory provisions for medical devices insofar as those provisions apply to the relevant product.
  2. Technical developments and design- or production-related modifications are reserved, provided they do not impair the agreed function or fitness for use.
  3. Product images and technical information provide a general product description. Customary or technically necessary deviations remain reserved, provided they are reasonable for the customer.
  4. If individual provisions of these Terms and Conditions are or become wholly or partially invalid or unenforceable, the remaining provisions remain unaffected. The invalid or unenforceable provision will be replaced by the applicable statutory provisions.
